    This page sets out the terms that apply when you use the Breath Embassy website, make a booking or participate in a Breath Embassy breathwork session. It also explains how Breath Embassy collects and handles personal information and provides important health and safety information about participating in breathwork.

    1. Terms & Conditions

    1.1 About Breath Embassy

    Breath Embassy provides guided breathwork and wellbeing experiences designed to support relaxation, self-awareness, embodiment and personal exploration.

    Breathwork is a wellbeing practice and is not a substitute for medical care, psychological treatment, psychiatric care or other professional healthcare.

    Unless expressly stated otherwise, Breath Embassy does not provide medical, psychological or psychiatric treatment.

    1.2 Bookings

    Bookings are confirmed once payment has been successfully received.

    When making a booking, you agree to provide accurate information and to disclose any health information that may be relevant to your ability to participate safely.

    You are responsible for checking that the date, time, location and details of your booking are correct.

    1.3 Payment

    Payment is required at the time of booking unless otherwise stated.

    Payments may be processed through third-party payment providers. These providers may collect and process payment information in accordance with their own privacy policies and terms.

    Breath Embassy does not generally receive or store complete credit or debit card details.

    1.4 Cancellations, refunds and transfers

    Bookings cancelled more than 24 hours before the scheduled session are eligible for a refund or transfer to another available session.

    Cancellations made less than 24 hours before the scheduled session and no-shows are not eligible for a refund or transfer, except where Breath Embassy agrees otherwise or where required by law.

    Nothing in this section limits any rights or remedies you may have under the Australian Consumer Law.

    1.5 Cancellation or postponement by Breath Embassy

    Breath Embassy may cancel, postpone or relocate a session where reasonably necessary, including because of facilitator illness, venue issues, safety concerns, insufficient attendance, severe weather or circumstances outside our reasonable control.

    Where Breath Embassy cancels a session, we will endeavour to provide reasonable notice and, where appropriate, offer a transfer, credit or refund.

    1.6 Participant responsibilities

    You agree to:

    • provide accurate information during booking and health screening
    • disclose relevant health conditions or circumstances
    • follow reasonable instructions provided by the facilitator
    • participate within your own physical and emotional limits
    • tell the facilitator if you feel unwell, unsafe or unable to continue
    • stop or modify an exercise whenever you feel it is necessary
    • behave respectfully towards the facilitator, venue staff and other participants
    • arrive completely sober and unimpaired. Alcohol and recreational drugs must not be consumed before or during a session. Participants must also disclose any medication or other substance that may affect their ability to participate safely. Breath Embassy is not responsible, to the extent permitted by law, for consequences arising from a participant attending while affected by alcohol or recreational drugs or failing to disclose relevant substances or medications.

    Nothing in these Terms & Conditions excludes liability that cannot legally be excluded.

    1.7 Right to refuse or discontinue participation

    Breath Embassy may decline or discontinue a participant's participation where the facilitator reasonably considers that participation may pose a safety risk to the participant, facilitator or others. This may include circumstances where relevant health information has not been disclosed, where a participant appears impaired, or where a participant is unable or unwilling to follow reasonable safety instructions.

    1.8 Non-sexual services

    All Breath Embassy services are strictly non-sexual. Sexual behaviour, sexual contact, solicitation or inappropriate conduct towards the facilitator or other participants is not permitted.

    Breath Embassy reserves the right to end a session and ask a participant to leave if their behaviour is inappropriate, sexual, threatening or otherwise compromises the safety or comfort of others.

    Breath Embassy also reserves the right to refuse future bookings where there are reasonable concerns about a participant's conduct or ability to respect these boundaries.

    1.9 Touch, bodywork and consent

    Some sessions may include optional touch, assisted movement or bodywork where this is clearly stated as part of the session.

    Any physical contact will be explained beforehand and will only take place with the participant's consent. Participants are free to decline touch or bodywork without giving a reason, and consent can be withdrawn at any time.

    Any touch or bodywork will be professional, respectful and appropriate to the purpose of the session. Participation in breathwork does not imply consent to physical contact.

    1.10 Age requirements

    Breath Embassy sessions are intended for adults aged 18 and over unless a particular event expressly states otherwise.

    Participants under 18 may not attend an adult Breath Embassy session without prior written approval from Breath Embassy and any additional consent or supervision requirements that may apply.

    If a session is specifically offered to people under 18, separate age-appropriate terms, consent and safeguarding requirements may apply.

    1.11 Australian Consumer Law

    Nothing in these Terms & Conditions excludes, restricts or modifies any rights or remedies that cannot lawfully be excluded under Australian law, including the Australian Consumer Law.

    Where applicable, services supplied by Breath Embassy are subject to consumer guarantees, including that services will be provided with due care and skill.

    Any limitation of liability in these Terms & Conditions applies only to the extent permitted by law.

    1.12 Liability

    You acknowledge that breathwork can involve physical, emotional and psychological experiences and that participation carries inherent risks.

    Breath Embassy takes reasonable steps to provide a safe environment and appropriate guidance.

    Participants remain responsible for monitoring their own wellbeing and should stop or modify an exercise if they feel unwell, unsafe or unable to continue.

    To the extent permitted by law, Breath Embassy is not responsible for loss, injury or damage arising from circumstances outside its reasonable control or from a participant's failure to disclose relevant information, follow reasonable safety instructions or participate within their own limits.

    Nothing in these Terms & Conditions excludes liability that cannot legally be excluded.

    1.13 Emergency situations

    If a participant experiences a medical or other emergency during a session, Breath Embassy may take reasonable steps to obtain assistance, including contacting emergency services or the participant's nominated emergency contact.

    By participating, you authorise Breath Embassy to take reasonable emergency action where necessary to protect your health or safety.

    1.14 Photography and recording

    Photography or video may occasionally take place during Breath Embassy events.

    Where an identifiable participant is intended to be used in promotional material, Breath Embassy will seek appropriate consent. Participants who do not wish to appear in photographs or video should notify Breath Embassy before the session or at the time photography is taking place.

    Consent to participate in a Breath Embassy session does not constitute consent to appear in promotional photography or video.

    Participants must not photograph, record or publish other participants without their consent.

    1.15 Respectful and inclusive environment

    Breath Embassy aims to provide a welcoming, respectful and inclusive environment.

    We may refuse participation or ask someone to leave a session where their behaviour presents a safety concern, significantly disrupts the experience or adversely affects another participant.

    1.16 Intellectual property

    Breath Embassy's branding, written materials, recordings, exercises, course materials and original content remain the property of Breath Embassy unless otherwise stated.

    You may not reproduce, distribute, sell or commercially exploit Breath Embassy materials without written permission.

    1.17 Changes to these Terms & Conditions

    We may update these Terms & Conditions from time to time to reflect changes to our services, business practices or legal obligations.

    The version applicable to your booking will generally be the version available at the time you make your booking.

    2. Privacy Policy

    2.1 Our approach to privacy

    Breath Embassy respects your privacy and handles personal information in accordance with applicable Australian privacy laws, including the Privacy Act 1988 (Cth) and the Australian Privacy Principles where they apply.

    2.2 Privacy contact

    Breath Embassy is operated by Troy Nankervis. Troy Nankervis is responsible for managing privacy enquiries and requests relating to personal information held by Breath Embassy.

    Depending on how you interact with Breath Embassy, we may collect:

    Health and safety information

    Where necessary to assess participant suitability and safety, we may collect health information that you voluntarily provide through health screening, registration or other communications.

    This may include information about relevant medical conditions, medications, injuries, pregnancy or other circumstances that may affect participation.

    Health information may be collected to help assess and manage whether participation in a particular session is appropriate and to support participant safety.

    If you choose not to provide health information that Breath Embassy reasonably considers necessary to assess or manage your safe participation, we may be unable to allow you to participate in a session.

    Health information is sensitive information under Australian privacy law and is subject to additional protections.

    Website and technical information

    When you visit our website, we may collect information such as:

    • IP address
    • browser and device information
    • pages visited
    • referring website
    • approximate location
    • website interaction data
    • cookies and similar technologies

    The information actually collected will depend on the technologies and services used on our website.

    Marketing information

    If you subscribe to Breath Embassy communications, we may collect information about your subscription and interactions with our marketing communications.

    2.4 Access to health information

    Health information provided through participant screening or registration will only be accessed by people who reasonably need access to perform their role, manage participant safety or comply with legal obligations.

    2.5 How we collect information

    We may collect information:

    • directly from you when you make a booking
    • through contact forms
    • through health screening or participant forms
    • when you communicate with us
    • when you subscribe to our mailing list
    • when you attend a Breath Embassy session
    • through our website
    • through cookies, analytics and similar technologies
    • through third-party booking and payment services

    Where practicable, we collect personal information directly from you.

    2.6 Why we collect information

    We may use personal information to:

    • process and manage bookings
    • provide breathwork services
    • assess participant suitability and safety
    • communicate with you
    • process payments
    • manage cancellations and refunds
    • respond to enquiries

    Health information is collected for participant safety and service provision, not for advertising purposes. We will only collect health information where reasonably necessary for our functions or activities and where we have the consent required by law.

    2.7 Consent to health information

    Health information is sensitive information under Australian privacy law and is subject to additional protections.

    Where required by law, Breath Embassy will obtain your consent before collecting health information.

    You may withdraw consent where legally and practically possible. However, withdrawing consent may mean that Breath Embassy cannot provide certain services where the information is reasonably necessary to assess or manage your safe participation.

    2.8 Third-party providers

    Breath Embassy uses third-party service providers and technology platforms to help operate our website, manage bookings and payments, communicate with clients, manage business records, analyse website usage and provide other business services.

    These providers may include website hosting and management services, booking and ticketing platforms, payment processors, email and marketing platforms, website providers, cloud storage providers, accounting software, analytics and advertising services, and professional advisers.

    These providers may process personal information on our behalf and may store or process information in Australia or overseas.

    We take reasonable steps to ensure that third-party providers handle personal information appropriately and in accordance with applicable privacy requirements.

    Where third-party providers have their own privacy policies or terms governing how they handle information, you should review those policies for further information about their practices.

    2.9 Google Analytics and website analytics

    Breath Embassy uses Google Analytics.

    Where analytics technologies are used, they may collect information about how visitors interact with the website, such as pages visited, device information and general usage patterns.

    Analytics technologies will be configured and used in accordance with applicable privacy requirements.

    2.10 Cookies, Meta and Google advertising technologies

    Our website may use cookies, pixels and similar technologies for website functionality, analytics and, where applicable, advertising.

    These may include technologies provided by platforms such as Meta and Google.

    Because Breath Embassy may collect sensitive health information, we take particular care to ensure that advertising and analytics technologies do not improperly collect or disclose health information.

    Breath Embassy does not intentionally use health information provided through health screening, registration or participant forms to create advertising audiences, retargeting audiences or similar marketing profiles.

    We will not knowingly configure advertising or tracking technologies to collect health information from health screening forms or other areas containing sensitive health information, except where permitted by law and with any consent required.

    2.11 Marketing communications

    Where permitted by law, Breath Embassy may send marketing communications to people who have subscribed to receive them or otherwise provided appropriate consent.

    Marketing communications may include newsletters, promotions, new sessions, events, special offers and other promotional content.

    Transactional or service-related communications may include booking confirmations, booking reminders, venue changes, cancellations and important information relating to a booked service.

    You can unsubscribe from marketing communications at any time using the unsubscribe mechanism provided or by contacting us.

    Unsubscribing from marketing communications will not prevent Breath Embassy from sending essential transactional or service-related communications reasonably necessary to manage your booking or participation.

    Marketing consent is separate from health and safety consent. You are not required to subscribe to marketing communications to participate in a session.

    2.12 Disclosure of information

    We may disclose personal information to third parties where reasonably necessary to operate Breath Embassy.

    This may include booking platforms, payment providers, email providers, website providers, cloud storage providers, accountants, insurers, professional advisers and technology providers.

    We may also disclose information where required or authorised by law, or where reasonably necessary to protect someone's health or safety.

    We do not sell your personal information. Health information is not disclosed to marketing or advertising providers for advertising purposes.

    2.13 Health information and marketing

    Health information collected for participant safety will not be used for direct marketing unless Breath Embassy has obtained the consent required under applicable privacy law.

    Health information collected for participant safety will be used primarily for the purposes for which it was collected.

    2.14 Overseas disclosure

    Some third-party technology providers may store or process information outside Australia.

    Where this occurs, we will take reasonable steps to address applicable privacy requirements relating to overseas disclosure.

    2.15 Security

    We take reasonable steps to protect personal information from misuse, interference, loss and unauthorised access, modification or disclosure.

    These measures may include access controls, passwords, authentication, secure software and restricted access to sensitive information.

    No online system can be guaranteed to be completely secure.

    2.16 Retention

    We retain personal information only for as long as reasonably necessary for the purposes for which it was collected, or where required for legal, accounting, insurance or other legitimate purposes.

    Health and safety information will be securely stored and disposed of in accordance with applicable legal, insurance and operational requirements.

    2.17 Access and correction

    You may request access to personal information Breath Embassy holds about you.

    You may also ask us to correct information that is inaccurate, incomplete or out of date.

    We may need to verify your identity before processing an access or correction request.

    2.18 Privacy complaints

    If you are not satisfied with our response, you may be able to make a complaint to the Office of the Australian Information Commissioner.

    2.19 Data breaches

    If Breath Embassy becomes aware of a data breach involving personal information, we will assess and respond to the incident in accordance with applicable privacy laws, including the Notifiable Data Breaches scheme where applicable.

    3. Breathwork Health & Safety Information

    3.1 Please read before participating

    Breathwork can be a powerful physical, emotional and experiential practice.

    Different breathing techniques can produce significant changes in breathing patterns and may result in physical sensations, emotional responses or changes in awareness.

    Breathwork is not appropriate for everyone or every circumstance.

    3.2 What you may experience

    During breathwork you may experience:

    • changes in breathing rate or depth
    • light-headedness or dizziness
    • tingling or altered sensations
    • changes in muscle tension
    • involuntary muscle movements or contractions
    • changes in temperature
    • relaxation or fatigue
    • emotional responses such as crying, laughter or vulnerability
    • anxiety or discomfort
    • temporary changes in perception or awareness
    • other unexpected physical or emotional sensations

    Everyone responds differently.

    You are never expected to push through discomfort.

    You may slow down, return to a normal breathing pattern, modify an exercise or stop participating at any time.

    3.3 Health conditions and suitability

    You must tell the facilitator about any health condition or circumstance that may affect your ability to participate safely.

    This may include, but is not limited to:

    • cardiovascular or heart conditions
    • blood pressure conditions
    • respiratory conditions
    • neurological conditions
    • epilepsy or seizure disorders
    • significant psychological or psychiatric conditions
    • recent surgery
    • significant injuries
    • pregnancy
    • medications that may affect consciousness, breathing, blood pressure or cardiovascular function
    • any other condition about which you have concerns regarding participation

    This list is not exhaustive.

    If you are unsure whether breathwork is suitable for you, speak with an appropriately qualified healthcare professional before participating.

    3.4 Medication and substances

    Participants must arrive completely sober and unimpaired. Alcohol and recreational drugs must not be consumed before or during a session.

    You should disclose relevant medication or other substances that may affect your ability to participate safely.

    If you are unsure whether medication or another substance could affect your participation, seek appropriate professional advice.

    3.5 Emotional and psychological experiences

    Breathwork may sometimes bring up strong emotions, memories or other psychological experiences.

    Breath Embassy does not guarantee any particular emotional, psychological or therapeutic outcome.

    Breathwork should not be regarded as a replacement for appropriate medical or mental health care.

    If you are experiencing significant psychological distress or have concerns about your mental health, seek appropriate professional support.

    3.6 During a session

    Participants are expected to:

    1. Follow reasonable instructions from the facilitator.
    2. Stay within their own physical and emotional limits.
    3. Tell the facilitator if they feel unwell or unsafe.
    4. Stop or modify an exercise when necessary.
    5. Respect the boundaries and wellbeing of other participants.

    The facilitator may also ask a participant to stop or modify an exercise where they believe this is necessary for safety.

    3.7 Emergency situations

    Although reasonable safety measures are taken, unexpected events can occur.

    If an emergency occurs, Breath Embassy may contact emergency services or your nominated emergency contact and provide reasonable assistance within the facilitator's training and capabilities.

    3.8 Informed consent

    By booking or participating in a Breath Embassy session, you acknowledge that:

    • you have read and understood this Health & Safety information
    • you understand that breathwork can produce significant physical and emotional experiences
    • you understand that you can stop or modify an exercise at any time
    • you have provided accurate information about relevant health conditions and circumstances
    • you understand that Breath Embassy is not providing medical or psychological treatment unless expressly stated otherwise
    • you understand that you should seek appropriate professional advice if you are unsure whether breathwork is suitable for you
    • you voluntarily choose to participate

    3.9 Participant declaration

    Before participating in a session, Breath Embassy may require you to confirm:

    I have read and understood the Breath Embassy Health & Safety information and consent to participate in the breathwork session.

    I confirm that I have disclosed any relevant health information that may affect my ability to participate safely.

    I understand that I may stop or modify the practice at any time.

    I confirm that I will arrive sober and unimpaired and will not participate while affected by alcohol or recreational drugs.
